Background of the case. The petitioner in this case, Aruna Ramchandra Shanbaug used to work as a Nurse in King Edward Memorial Hospital, Parel, Mumbai. On the evening of the 27th November 1973 a sweeper of the same hospital attacked her and he wrapped her neck with a dog chain and yanked her back with it. The sweeper also tried to rape her but The Judgment in Aruna Shahbaug case. However in the present case, as no indication of Aruna Shanbaug's views or wishes with respect to life-sustaining treatments for a permanent vegetative state, any decision regarding her treatment will have to be taken by a surrogate i.e. the staff of the KEM hospital have looked after her for 37 years Aruna Ramachandra Shanbaug v. Union of India[1], is one of the most renowned cases which urged for the need to change the Euthanasia laws in India. The Case discussed the constitutionality of Passive Euthanasia and had checked whether Right to die will come under the meaning of Article 21 of the Indian Constitution. A brutal assault in 1973 cut off blood and oxygen supply to key parts of Aruna Shanbaug's brain. Forty-two years after the crime against Aruna Shanbaug, a new crime against the Constitution is in The Hon'ble Supreme Court on March 9 ruled that individuals had a right to die with dignity, allowing passive euthanasia with guidelines. The need to change euthanasia laws was triggered by the famous Aruna Shanbaug case. The constant, ever-lasting debate on whether 'Right to Die' can also be read into this provision still lingers in the air. Aruna Shanbaug passed away on the 18th of May, 2015 due to pneumonia. The inputs of Justice D.Y. Chandrachud in this case On the 9th of march 2018 , a five judge bench consisting of Chief Justice Dipak Misra, A.K. Sikri, A.M. Khanvilkar, D.Y. Chandrachud and Ashok Bhushan held that the right to die with dignity is a fundamental right.
